APPLICABLE LAW; JURISDICTION

The Site is operated in the United States. These Terms will be governed by and construed in accordance with the laws of the United States and the State of Illinois, as applicable. Any arbitration will be conducted by the American Arbitration Association (the "AAA") under its Commercial Arbitration Rules, or other applicable AAA rules. You and 88 Brand Partners agree to commence arbitration only in Cook County, Illinois State, U.S. You may request a telephonic or in-person hearing by following the AAA rules. In a dispute involving $10,000 or less, any hearing will be telephonic unless the arbitrator finds good cause to hold an in-person hearing instead. The arbitrator may award the same damages to you individually as a court could. The arbitrator may award declaratory or injunctive relief only to you individually, and only to the extent required to satisfy your individual claim.

To the extent permitted by law, any claim or dispute under these Terms must be filed within one year in an arbitration proceeding. The one-year period begins when the claim or notice of dispute first could be filed. If a claim or dispute is not filed within one year, it is permanently barred.

In the event of an arbitration, neither you nor we will have the right to litigate that claim in court or have a jury trial on the claim, or to engage in pre-arbitration discovery except as provided in the code or procedures of the AAA, as applicable. Further, you will not have the right to participate in a representative capacity or as a member of any class of claimants pertaining to any claim subject to arbitration. The arbitrator's decision will be final and binding. Other rights that you would have if you went to court may also not be available in arbitration.

If any other provision of this section is found to be illegal or unenforceable, that provision will be severed, with the remainder of this section remaining in full force and effect. If arbitration is found to be illegal or unenforceable, the state courts of the State of Illinois in and for Cook County and no other court or tribunal, shall have sole and exclusive jurisdiction to hear and determine any suit, action, proceeding, claim, controversy or dispute you have with 88 Brand Partners in connection with the Site; in such event, you irrevocably consent to the jurisdiction of the said courts, and venue therein.
